Règlement des différendsMots-clés : règlement des différends cour étatique tribunal arbitral clause compromissoire consentement accord notion de "separability" existence autonomie des parties choix de loi Index. décimale : 000 - pas d'indexation décimale connue Résumé : The ultimate question that runs through all of our law of arbitration is the allocation of responsibility between state courts and arbitral tribunals: If private tribunals assume the power to bind others in a definitive fashion, we must ask, where does this authority come from ? Fundamentally different in this respect from a state judge, a private arbitrator may only derive his legitimacy from that exercise of private ordering and self-government which characterizes any voluntary commercial transaction. This work begins then with the dimensions of that "consent" which alone can justify arbitral jurisdiction. The discussion is then carried forward to explore how party autonomy in the contracting process may be expanded, giving rise to the voluntary reallocation of authority between courts and arbitrators. It concludes with the necessary inquiry into the autonomy with respect to the "chosen law" that will govern the agreement to arbitrate itself. Titre : The future of investment arbitration Type de document : texte imprimé Auteurs : Catherine ROGERS, Auteur ; Roger P ALFORD, Auteur Editeur : Oxford University Press Année de publication : 2009 Importance : 375 pages ISBN/ISSN/EAN : 978-0-19-537180-2 Langues : Français (fre) Catégories : Règlement des différends Mots-clés : arbitrage investissement Index. décimale : 000 - pas d'indexation décimale connue Résumé : Investment arbitration is at the cutting edge of international law and dispute resolution, and is predicted to be a major factor in the development of the global economic system in years to come. This one-volume monograph contains contributions from leading experts on a wide range of topics of both theoretical importance and practical implication that will affect the future of investment arbitration. The highly innovative chapters combine to form a constructive and valuable discussion for all in the arbitration field. The contributors, chosen to represent the full spectrum of perspectives, are leading arbitration experts from all over the world, including ICSID insiders, US government officials, UNCTAD research personnel, seasoned investment arbitrators and counsel, and renowned legal scholars. The book is divided into three themes, with the first centering on the adequacy of UNCITRAL and ICSID arbitration rules, with particular attention to recent and proposed changes. The second theme focuses on the future of bilateral investment treaties, discussing trends in the interpretation of treaty provisions and the debate concerning the efficacy of the treaties in benefiting developing countries. The third theme revolves around the public function of investment arbitration decisions, including the use of arbitration to resolve disputes between sovereigns and the arbitrators' role as a guardian of international public policy. The Future of Investment Arbitration is unique in its outstanding range of topics and the expertise of the contributors. It previews and guides future directions in the field, as well as discussing the larger policy implications of specific rules. It includes cutting-edge analysis of empirical research regarding BITS that is essential to evaluating many assumptions about investment law and arbitration. Finally, the book takes a broad perspective, examining the rules discussed within the larger structural context of investment arbitration, and drawing investment arbitration into the wider setting of international law and corporate governance. Titre : The Law and Practice of United States Arbitration Type de document : texte imprimé Auteurs : Thomas E.CARBONNEAU, Auteur Editeur : JurisNet LLC Année de publication : 2020 Collection : Seventh Edition Importance : 604 pages ISBN/ISSN/EAN : 8032919996824 Langues : Anglais (eng) Catégories : Règlement des différends Mots-clés : law practice United States arbitration Index. décimale : 000 - pas d'indexation décimale connue Résumé : The Law and Practice of United States Arbitration is a comprehensive treatise about the development and practice of arbitration law in the United States. It addresses in detail the recourse to arbitration in domestic matters -- employment, labor, consumer transactions, and business -- and its use in the resolution of international commercial claims. It covers all of the major subject areas in the field and provides practical advice as well as an easy-to-read, clear discussion of the relevant case law. It represents a masterful synthesis of the entire body of arbitration law. It discusses basic concepts and doctrines, the FAA, freedom of contract in arbitration, arbitrability, the enforcement of awards, the use of arbitration in consumer and employment matters, institutional arbitration, and the drafting of arbitration agreements. It describes the federalization of the law and growing judicial objections to the use of adhesive arbitration agreements in the consumer context. A special edition of The Law and Practice of Arbitration was adapted and issued as Volume 31 of Moore's Federal Practice, one of the nation's leading treatises on federal courts and procedure. Moore's Federal Practice, published by LexisNexis, is one of the most cited texts in the legal world with over 50,000 citing opinions since it was first published in 1938.
The Seventh Edition of Law and Practice of United States Arbitration brings the existing material completely up-to-date and takes into account and provides thorough commentary on SCOTUS’ latest decisions. It provides a unique perspective into the value of arbitration for American society, the American legal system, and global commerce. Although the attachment to political convictions has mired arbitration into an unproductive debate in adhesive arbitration, that aspect of the use of arbitration has nothing to do with its larger mission. Arbitration is unique in the experience of American law because it actually works and achieves its aims. It is imbued in the Western democratic tradition and in that sense may be a difficult fit in other regions of the world. Finally, the support from national High Courts for arbitration is a vital part of the success of the process. Arbitration in the United States, England, and France would not have progressed and developed so well without the unqualified support of the judiciary. The Law and Practice of United States Arbitration [texte imprimé] / Thomas E.CARBONNEAU, Auteur . - JurisNet LLC, 2020 . - 604 pages. - (Seventh Edition) .

Règlement des différendsMots-clés : arbitrage internationale arbitrage Index. décimale : 000 - pas d'indexation décimale connue Résumé : This Handbook brings together many of the key scholars and leading practitioners in international arbitration, to present and examine cutting-edge knowledge in the field. Innovative in its breadth of coverage, chapter-topics range from the practicalities of how arbitration works, to big picture discussions of the actors involved and the values that underpin it. The book includes critical analysis of some of international arbitrations most controversial aspects, whilst providing a nuanced account overall that allows readers to draw their own informed conclusions. The book is divided into six parts, after an introduction discussing the formation of knowledge in the field. Part I provides an overview of the key legal notions needed to understand how international arbitration technically works, such as the relation between arbitration and law, the power of arbitral tribunals to make decisions, the appointment of arbitrators, and the role of public policy. Part II focuses on key actors in international arbitration, such as arbitrators, parties choosing arbitrators, and civil society. Part III examines the central values at stake in the field, including efficiency, legal certainty, and constitutional ideals. Part IV discusses intellectual paradigms structuring the thinking in and about international arbitration, such as the idea of autonomous transnational legal orders and conflicts of law. Part V presents the empirical evidence we currently have about the operations and effects of both commercial and investment arbitration. Finally, Part VI provides different disciplinary perspectives on international arbitration, including historical, sociological, literary, economic, and psychological accounts. Règlement des différendsMots-clés : exception d'ordre public arbitrage international convention de New York Index. décimale : 000 - pas d'indexation décimale connue Résumé : The Public Policy Exception under the New York Convention: History, Interpretation, and Application describes in detail the drafting history of the public policy exception of Art. V (2) (b) of the New York Convention in order to determine the purpose the signatory states wanted to achieve with this clause. The book also explains how this clause is applied by the courts in many economically relevant states, and especially in Brazil, Russia, India, and China.
In September 2012, the Indian Supreme Court, in a case entitled Bharat Aluminium Co. v. Kaiser Aluminium Technical Service, Inc., announced a long expected decision practically reversing the judgments of Bhatia International and Venture Global and holding that Indian Courts are not permitted to set aside foreign arbitral awards. In this Revised Edition, the author explains and explores the reasoning of the Indian Supreme Court in this landmark decision and discusses the practical implications and consequences.
Public Policy Exception under the New York Convention: History, Interpretation, and Application is of importance for all internationally active companies as well as for lawyers and courts. The book aids lawyers and companies in drafting arbitration clauses and in enforcing foreign arbitral awards. Often, judgments will not be enforced abroad; this is especially true with respect to an enforcement of foreign judgments in the BRIC countries. Therefore, internationally active companies and their advisors need guidance if and where foreign arbitral awards in their favor will be enforced abroad. The Public Policy Exception Under the New York Convention = History, Interpretation and Application [texte imprimé] / Anton G. Règlement des différendsMots-clés : Covid-19 pandémie arbitrage commercial international arbitrage d'investissement investissement commercial disputes droit du commerce international lex mercatoria enjeux Résumé : In this book, senior judges and academics at the forefront of transnational commercial law in Asia, Australia, Europe, the US, and elsewhere, reflect on the implications of anti-globalism and the COVID-19 pandemic on international commercial dispute resolution (ICDR).
The chapters consider: (1) What types of cross-border commercial disputes will arise in the future and what resources will be needed to respond to them in a cost-effective, time-efficient, and equitable manner? (2) Is there still merit in a multilateral approach to transnational commercial law and ICDR, despite the closing of borders, the rise of protectionism, and the disruption of global supply chains? (3) What reforms and innovations should courts, arbitrators, and mediators contemplate when navigating the post-pandemic landscape? (4) Can the accelerated use of remote technology in ICDR (as prompted by the pandemic) be leveraged to enhance access to justice for all?
With a focus on the current crisis in globalism, as well as the associated problems of ensuring justice and fairness in the resolution of cross-border commercial and investment-state disputes along the Belt-and-Road and elsewhere, the book will be an invaluable resource for academics, judges and practitioners alike.Transnational Commercial Disputes in an Age of Anti-Globalism and Pandemic [texte imprimé] / Sundaresh MENON, Auteur ; Anselmo REYES, Auteur . - Hart Publishing, 2023 . - 392 pages ; Relié.

Combining both theory and practice, it is written by leading academics and practitioners from Europe, Asia and the Americas to ensure the book has a balanced international coverage. The book not only provides an article-by-article critical analysis, but also incorporates information on the reality of legal practice in UNCITRAL jurisdictions, ensuring it is more than a recitation of case law and variations in legal text. This is not a handbook for practitioners needing a supportive citation, but rather a guide for practitioners, legislators and academics to the reasons the Model Law was structured as it was, and the reasons variations have been adopted.
