of issues that arise in international commercial arbitration. Very little
research has, however, been done on the dogmatic underpinnings of the
concept and its actual legal relevance. This course follows the
development of the so-called “soft law” from its origins in public
international law to commercial arbitration, where it is used today as a
label for various instruments and phenomena, covering both procedural
aspects and the applicable substantive law: model laws, arbitration
rules, guidelines, the UNIDROIT Principles, the lex mercatoria, and
others.
It presents three particularly well-known sets of guidelines by the
International Bar Association and discusses the pros and cons of “soft
law” instruments and their potential normativity. The analysis suggests
that “soft law” instruments are typically less well recognised in practice
than is generally assumed. The author explains what such instruments
can achieve and what minimum requirements they have to full to at
least aspire to some legitimacy. He argues ultimately that “soft law”
instruments can be very useful tools, but they do not carry any

Après l'avènement du Livre blanc de la Commission européenne sur le sport, la tenue du Congrès de l'Agence Mondiale Antidopage en 2007, des événements sportifs comme la Coupe d'Afrique des Nations (football) en janvier 2008, la Coupe d'Europe des Nations en juin 2008 et les Jeux Olympiques en août 2008, l'heure était venue d'analyser l'évolution du droit du sport notamment en relation avec les conflits, les règlements judiciaires et arbitraux.
Lors de la journée du 6 décembre 2008 à Bruxelles, sous la présidence de Gérald Simon (Professeur à l’Université de Bourgogne, Directeur du Laboratoire de Droit du Sport de l’Université de Bourgogne et arbitre au Tribunal arbitral du sport, Lausanne) et Thierry Zintz (Vice-Président du Comité Olympique et Interfédréal Belge (COIB) et également Professeur à l’UCL spécialisé en managment des organisations sportives), nous avons étudié le rôle des associations et fédérations sportives ainsi que le Livre blanc de la Commission européenne sur le sport (avec l'intervention d'Alexandre Husting – chercheur –, Gianluca Monte et Sébastien Proisy – membres de l'Unité Sport de la DG Education et Culture de la Commission européenne–).
Une attention particulière est portée sur la problématique du dopage et son code (analysée par Cécile Chaussard) ainsi que sur le règlement des litiges qui en découlent lors des évènements (comme le Tour de France et les Jeux Olympiques) notamment par le règlement des différentes instances disciplinaires et du Tribunal arbitral du Sport, traité par Patrick Mbaya.
Les sujets abordés ainsi que les différentes thématiques importantes analysées sont d'une actualité intéressante et de plus en plus répétitive pour tous les praticiens du droit du sport (chercheurs, juristes d'entreprise, avocats, magistrats, etc.). Il est également destiné à la formation des agents de joueurs, très souvent délaissés à leur simple connaissance des différents mécanismes abordés, aux clubs employeurs, appelés à appliquer les différentes législations et les règlements sportifs et, le cas échéant, à plaider devant les juridictions sportives disciplinaires et arbitrales.

Investment treaty arbitral tribunals commonly address, as a matter of international law, an alleged breach of a contract (or other legal obligation concerning an investment) that is often regulated by municipal law. However, there is no selfcontained legal system that provides substantive rules of direct applicability for these tribunals. In practice, approaches range from complete exclusion of municipal law to complete reliance on municipal law. While the former has no defensible foundation in international law, an absolute renvoi to municipal law runs afoul of the principle that international law governs the characterization of an internationally wrongful act. Arguing that international investment law requires a more nuanced consideration of the role of municipal law than many arbitral tribunals have implemented to date, this book provides a detailed, systematic approach to the interplay of municipal law and international law in investment disputes. The treatment focuses on the role of municipal law in providing the substance for concepts such as contracts, property rights, and shareholders' rights, which are relevant in the international investment treaty context but are not regulated under international law.
