Since fall 2006: a new, revised edition of Unidroit Principles in Practice, featuring approximately 120-130 cases.
The UNIDROIT Principles of International Commercial Contacts, published in 1994, were an entirely new approach to international contract law. Prepared by a group of eminent experts from around the world as a "restatement" of international commercial contract law, the Principles are not a binding instrument but are referred to in many legal matters. They are widely recognized now as a balanced set of rules designed for use throughout the world irrespective of the legal traditions and the economic and political conditions of the countries in which they are applied.
The UNIDRIOT Principles in Practice provides a comprehensive collection of international caselaw and bibiliographic materials relating to the Principles. In particular, it contains:
the text and official comments of the UNIDROIT Principles;
over 70 decisions by courts and arbitral tribunals worldwide referring to the UNIDROIT Principles;
a vast bibliography.
In addition to a general bibliography, there are bibliographical references pertinent to individual articles.The Unidroit Principles in Practice = Caselaw and Bibliography on the Unidroit Principles of International Commercial Contracts [texte imprimé] / Michael Joachim BONELL, Auteur . - 2ème édition . - Transnational Publishers, 2006 . - 1156 pages ; Broché.

Titre : Trade related aspects of intellectual property rights Titre original : A Commentary on the TRIPS Agreement Type de document : texte imprimé Auteurs : Carlos Maria CORREA, Auteur Mention d'édition : 2ème édition Editeur : Oxford University Press Année de publication : 2020 Importance : 592 pages Format : Relié ISBN/ISSN/EAN : 978-0-19-870721-9 Langues : Anglais (eng) Catégories : Droit du commerce, droit du commerce international
Propriété industrielleMots-clés : propriété intellectuelle convention ADPIC portée commentaires application internationalité marques indications géographiques designs et modèles brevets contrefaçon action en contrefaçon Index. décimale : 343.087 : Commerce international (droit) Résumé : The TRIPS Agreement is the most comprehensive and influential international treaty on intellectual property rights. It brings intellectual property rules into the framework of the World Trade Organization, obliging all WTO Member States to meet minimum standards of intellectual property protection and enforcement. This has required massive changes in some national laws, particularly in developing countries. This volume provides a detailed legal analysis of the provisions of the TRIPS Agreement, as well as elements to consider their economic implications in different legal and socio-economic contexts. This book provides an in depth analysis of the principles and of the substantive and enforcement provisions of the TRIPS Agreement, the most influential international treaty on intellectual property currently in force. It discusses the legal context in which the Agreement was negotiated, the objectives of their proponents and the nature of the obligations it created for the members of the World Trade Organization. In particular, it examines the minimum standards that must be implemented with regard to patents, trademarks, industrial designs, geographical indications, copyright and related rights, integrated circuits, trade-secrets and test data for pharmaceutical and agrochemical products. Trade Related Aspects of Intellectual Property Rights: A Commentary on the TRIPS Agreement elaborates on the interpretation of provisions contained in said Agreement, in the light of the customary principles for the interpretation of international law. The analysis -which is supported by a review of the relevant GATT and WTO jurisprudence- identifies the policy space left to such members to implement their obligations in accordance with their own legal systems and public policy objectives, including in respect of complex issues such as patentability criteria, compulsory licenses, exceptions and limitations to copyright, border measures, injunctive relief and the protection of test data under the discipline of unfair competition.
