It was the first gathering of members of the European Court of Justice, judges of the International Court of Justice, EU Member State judges, distinguished arbitrators, representatives of arbitral institutions and academics convened at the aftermath of the recent Achmea ruling of the European Court of Justice. Part I focuses on the existence of systemic conflicts and incompatibilities between international investment law and EU law. After providing an overview of various investment agreements, the author examines a variety of issues that may arise from the overlap of EU law and international investment law and arbitration. Part II deals with the issue of recourse to international arbitration as a means of settlement of disputes to which EU law may be applicable, in particular, four key issues that characterize the relationship of EU law with international investment arbitration in light of the recent ECJ judgment in Achmea. Part III is a comparison of the substantive standards of investment protection under EU law and international investment law. The volume also includes the proceedings of the animated debates that followed each session of the Roundtable. The shift towards multi-jurisdictional business transactions has resulted in an increase in international disputes. Rules of evidence, on the other hand, including evidentiary privileges, have been conceived for proceedings in local courts and are not adjusted to international disputes submitted to arbitration. In addition, arbitration laws and arbitration rules do not provide any guidance on how arbitral tribunals should deal with evidentiary privileges, although rules of evidentiary privilege can vary considerably throughout the world. For example, common law jurisdictions, which generally provide for extensive disclosure, will usually contain highly developed and varied evidentiary privilege rules, while civil law jurisdictions, where disclosure is limited, will afford less protection to evidentiary privileges. The purpose of this book is to review the evidentiary privileges existing under English, American, Swiss and French law that are the most likely to be invoked in arbitration, to determine which laws govern evidentiary privileges in international arbitration and, finally, to determine whether there exists a preponderance of practice suggesting that certain evidentiary privileges could develop into transnational rules in international arbitration. La reddition de la sentence arbitrale, si elle permet au plaideur d’obtenir satisfaction sur le fond du droit, n’a d’intérêt que si elle s’accompagne d’un recouvrement de la créance par le créancier. L’exécution des sentences est donc une étape essentielle de l’arbitrage. Pour les opérateurs économiques, c’est même un enjeu décisif. Sans exécution, l’obtention d’une décision de justice favorable s’apparente à une victoire à la Pyrrhus.
L’internationalité de l’arbitrage donne une dimension particulière à cette problématique. L’exécution de la sentence nécessite une réflexion à l’échelle mondiale, les actifs du débiteur pouvant être situés dans un ou plusieurs pays étrangers au créancier. Cette réflexion devrait conduire les opérateurs économiques à anticiper en sécurisant l’exécution des sentences arbitrales en amont. D'une part, cela passe par l’adoption d’une stratégie contentieuse adaptée et, d’autre part, par le respect de diligences juridiques spécifiques. Si cela ne suffit pas, il devient alors nécessaire de recourir à l’exécution forcée de la sentence arbitrale. À cette occasion, les États peuvent devenir les alliés ou les ennemis des créanciers, en apportant leur concours à l’exécution ou en s’y opposant.
L’objectif du colloque est de revenir sur les outils permettant aux parties de sécuriser et forcer l’exécution des sentences arbitrales internationales. Le terrain de l’exécution est à la fois économique, politique et juridique. L’ouvrage propose ainsi d’offrir un « vade-mecum » de l’exécution des sentences arbitrales internationales, tout en abordant des questions théoriques essentielles. C’est donc sur un terrain sablonneux et changeant, mais non moins passionnant, que cet ouvrage propose d’explorer.
