International economic law in the 21st century / Ernst-Ulrich PETERSMANN
Titre : International economic law in the 21st century Titre original : Constitutional pluralism and multilevel governance of interdependent public goods International economic law in the twenty-first century Type de document : texte imprimé Auteurs : Ernst-Ulrich PETERSMANN, Auteur Editeur : Hart Publishing Année de publication : 2012 Importance : 574 pages Format : Broché ISBN/ISSN/EAN : 978-1-84946-063-7 Langues : Anglais (eng) Catégories : Droit international économique Mots-clés : commerce international biens collectifs mondiaux droits de l'homme gouvernance mondiale droit international économique crise relations économiques internationales 21è siècle pluralisme constitutionnel Index. décimale : 343.087 : Commerce international (droit) Résumé : The state-centred 'Westphalian model' of international law has failed to protect human rights and other international public goods effectively. Most international trade, financial and environmental agreements do not even refer to human rights, consumer welfare, democratic citizen participation and transnational rule of law for the benefit of citizens. This book argues that these 'multilevel governance failures' are largely due to inadequate regulation of the 'collective action problems' in the supply of international public goods, such as inadequate legal, judicial and democratic accountability of governments vis-a-vis citizens. Rather than treating citizens as mere objects of intergovernmental economic and environmental regulation and leaving multilevel governance of international public goods to discretionary 'foreign policy', human rights and constitutional democracy call for 'civilizing' and 'constitutionalizing' international economic and environmental cooperation by stronger legal and judicial protection of citizens and their constitutional rights in international economic law. Moreover intergovernmental regulation of transnational cooperation among citizens must be justified by 'principles of justice' and 'multilevel constitutional restraints' protecting rights of citizens and their 'public reason'. The reality of 'constitutional pluralism' requires respecting legitimately diverse conceptions of human rights and democratic constitutionalism. The obvious failures in the governance of interrelated trading, financial and environmental systems must be restrained by cosmopolitan, constitutional conceptions of international law protecting the transnational rule of law and participatory democracy for the benefit of citizens. Droit international économiqueMots-clés : électricité marché droit international économique OMC aspects économiques et géopolitiques expériences régionales promotion de l'électricité "verte" Index. décimale : 000 - pas d'indexation décimale connue Résumé : Cross-border trade in electricity is rapidly expanding as a result of technical innovations, economic and geopolitical developments, and the ongoing decarbonisation of the electricity sector in response to climate change. The expansion of electricity networks and the integration of increasing shares of renewable energy (RE) electricity into the grid have made long-distance electricity flows both feasible and desirable. Drawing on the work of experts in trade and energy law and policy, and offering novel, multidisciplinary perspectives on the rapidly evolving landscape shaping international trade in electricity, this book examines the most important challenges - technical, economic, legal and policy-related - posed by long-distance and sustainable electricity trade. The book explores the regulatory implications of the policy instruments aimed at supporting RE electricity and considers how best to promote greater overall coherence in international electricity governance.
