Globalization, however, subjects public contracting to an increasing number of processes that take place at a transnational level and that have transformative impact on the very concept of public contracts law. Globalization, in other words, has the effect of reshaping public contracts into instruments of governance within a transnational legal space.
In adopting a transnational concept of law, the present book maps the different processes, actors and instruments involved in the transnationalization of public contracts law. It covers the impact of different areas of binding international law on public contracts as well as less obvious and more indirect processes in which domestic public contracting becomes influenced by the activities of private and public entities, such as multinational enterprises or international organizations, through lending and financing, or by developing model laws or model agreements for certain areas of public contracting.Transnational Law of Public Contracts [texte imprimé] / Mathias AUDIT, Auteur ; Stephan W. Règlement des différendsMots-clés : règlement des différends compétence-compétence principe arbitre "illegality" public policy international arbitration lex contractus lex arbitri autonomu of the parties choix de lois compétence de l'arbitre missions rôle limites corruption sanctions Index. décimale : 000 - pas d'indexation décimale connue Résumé : Competence-competence and corruption have, for different reasons, been mainstays of international dispute resolution thought and practice for the longest time. In the last few years, their intersection has become increasingly important and problematic. These lectures seek to define the problem and to provide acceptable solutions where possible. They attempt to derive support from both a stringent dogmatic approach and pragmatic attention to real-life expectations and conduct. More so than in other areas of private international law, the intersection between the powers of the arbitrator and the illegality of the subject matter or the parties' conduct poses a particular challenge. That challenge is to postulate proper solutions under the law, including principles of transnational or international law, to conduct which can take on a multiplicity of appearances owing to conflicting cultural understandings of what is and is not legal in commercial life. The statement that bribery and corruption offend transnational or international public policy does not relieve the arbitrator from the burden of scrutinizing that statement doctrinally and exploring its consequences in a period of ever-increasing globalization of economic activity and investment.
