It provides the basis for transnational sales transactions in about 50 countries, including most of the EU member states, the USA, Canada, Australia, New Zealand and China. The United Nations Uniform Sales Law is applied by courts and arbitration tribunals around the world. Individual jurisdiction's domestic laws are based on the UN Sales Law and it has influenced numerous modern codes, making the Convention an indispensable source for scholars and practitioners dealing with sales law worldwide. This commentary is a translation of the second edition of the German "Kommentar zum Einheitlichen UN-Kaufrecht - CISG" published in 1995. This English edition has been brought totally up to date, including case law up to the Spring of 1997. The team of authors - experts in their respective fields, several of whom were involved in the drafting of the Convention itself - provide a commentary on each article, describing its history, underlying policies and connections with other articles, analysing key scholarly views and court decisions and dealing with the article itself. Titre : Judicial Remedies in International Law Type de document : texte imprimé Auteurs : Christine D. GRAY, Auteur Editeur : Clarendon Press Année de publication : 1987 Importance : 270 pages Format : Relié ISBN/ISSN/EAN : 978-0-19-825571-0 Langues : Anglais (eng) Catégories : Droit international public et organisations internationales
Règlement des différendsMots-clés : judicial remedies international law international arbitration world court special tribunals Index. décimale : 000 - pas d'indexation décimale connue Résumé : The question of the consequences of breaches of international law is only now beginning to attract the attention it deserves. This book deals with one aspect of that wider question: it is the first comprehensive study of judicial remedies in international law. The author investigates the early development of judicial remedies through the varied practice of international arbitral tribunals; the diversity of these decisions makes it doubtful whether such tribunals ever evolved any consistent rules governing judicial remedies. The significance of the contributions made by the Permanent Court of International Justice, its successor the International Court of Justice, and specialized tribunals such as the European and American courts of human rights and the United Nations administrative tribunal is then evaluated. The pronouncements of these courts and tribunals on damages and restitution in integrum, on satisfactions, and declaratory judgments raise basic questions: are there any general principles underlying judicial remedies? Are remedies derived from municipal legal systems necessarily suitable at the international level? Readership: legal scholars, practising international lawyers, government legal advisers and advanced students of International Law.
