The FIDIC Red Book Contratct : An International Clause-by-Clause / SEPPÄLÄ, Christopher R.
Titre : The FIDIC Red Book Contratct : An International Clause-by-Clause : Incorporating the amendments in the 2022 reprint of the Red Book Type de document : texte imprimé Auteurs : SEPPÄLÄ, Christopher R., Auteur ; KONDEV, Dimitar, Auteur Editeur : KLUWER LAW INTERNATIONAL Année de publication : 2023 ISBN/ISSN/EAN : 978-94-035-2060-5 Langues : Français (fre) Résumé : Conditions of Contract for Construction known universally as the Red Book published by the International Federation of Consulting Engineers (known by its French acronym FIDIC) is the most widely used standard form of international construction contract. This book is a detailed commentary on the 2022 reprint of the 2017 FIDIC Red Book. For each of the Red Book's 168 Sub-Clauses the commentary: identifies changes from the 1999 edition; analyses the meaning and significance of the Sub-Clause and lists related Sub-Clauses; describes related international arbitration awards, national court decisions and Legal principles; and, where appropriate. proposes amendments to improve the Sub-Clause. As the FIDIC Yellow and Silver Books are very similar to the Red Book, much of the commentary is equally applicable to those forms of contract. The author is a FIDIC 'insider' having served for more than thirty years as Legal/Special Adviser to, or Member of, the FIDIC Contracts Committee which is responsible for preparing FIDIC's contracts. This book is an indispensable resource for ail parties called on to work with a FIDIC contract.
With guidance for every stage of a construction project, whether in drafting, negotiating, performing, interpreting, or administering a FIDIC contract, the book's easy-to-use structure includes tuch issues and topics as the following:
• introduction to FIDIC and its contracts and to publications of FIDIC and others relevant to the Red Book including the 2022 FIDIC Contracts Guide;
• critical examination of each Sub-Clause and advice for amending the same in order to becter adapt it to the interests of each party (the Employer or the Contractor);
• special attention to each Sub-Clause relating to the Contractor's and the Employer's daims and daims procedure and to how to assert daims effectively, as well as to time bars and other pitfalls and how they may be overcome;
• detailed examination of Sub-Clauses relating to the referral of issues or disputes to the Dispute Avoidance/Adjudication Board and, if necessary, to international arbitration, and optimal strategies for doing so;
• discussion of the changes required to the 2017 Red Book by The World Bank's Conditions of Particular Application I'COPA');
• reference, where appropriate, to the UNIDROIT Principles of International Commercial Contracts and trade usages;
• comprehensive discussion of practical issues that arise under common law, civil law and international Legal principles, especially when a contract is with a state or public body;
• comparison of common law and civil law methods of contract interpretation and a suggested practical approach to interpretation given a FIDIC contract's international arbitration clause; and
• overcoming problems that can arise when a contract is governed by the law of a less-developed country.
Legal and technical terms are clearly defined, and numerous figures and tables are included to illustrate steps in contract procedures. Detailed attention is paid to terminological distinctions among the various legal traditions, including a comparison of British-English and American-English construction contract terms.
Unquestionably the most detailed and thorough commentary ever published on the FIDIC Red Book, this highly practical work enables preparers of FIDIC contracts to amend and adapt the Red Book's provisions to a particular project. Dispute adjudicators, arbitrators, and judges will welcome the book's authoritative guidance on interpreting the provisions of a FIDIC contract, and engineers and other construction professionals involved in contract administration will appreciate the book's many practical features.The FIDIC Red Book Contratct : An International Clause-by-Clause : Incorporating the amendments in the 2022 reprint of the Red Book [texte imprimé] / SEPPÄLÄ, Christopher R., Auteur ; KONDEV, Dimitar, Auteur . - KLUWER LAW INTERNATIONAL, 2023.

Titre : Access to Justice in Arbitration Titre original : Access to Justice in Arbitration Type de document : texte imprimé Auteurs : Leonardo V.P. de OLIVEIRA, Auteur ; Sara HOURANI, Auteur Editeur : KLUWER LAW INTERNATIONAL Année de publication : 2020 Importance : 368 pages Format : Relié ISBN/ISSN/EAN : 978-94-035-0691-3 Langues : Anglais (eng) Catégories : Règlement des différends Mots-clés : arbitration arbitrage accès à la justice access to justice voluntary arbitration fairness independance accessibility courts tribunals investment arbitration specific disputes labour and employment arbitration sports arbitration unilaterally binding arbitration online dispute resolution blockchain-based arbitration WIPO SIAC ICSID Index. décimale : 347.09 : Règlement de conflits (droit) Résumé : The exponential growth of arbitration beyond commercial and investment matters, reaching disputes that have traditionally been decided by courts - such as labour and employment, sports, and competition disputes, and those involving human rights violations - raises questions about the impact of this expansion on access to justice. This collection of essays by arbitral practitioners, academics, and arbitral institution officials presents, for the first time, an in-depth analysis of the role access to justice plays in arbitration. Overall, the book assesses how access to justice can be guaranteed in arbitration and, in particular, shows how access to justice works in various types of arbitration.
The book and its contributions will be of immeasurable value in determining the practical application of such concerns as the following:
when issues of access to justice can be raised in arbitral disputes and when violations of access to justice can be challenged;
ramifications of arbitration clauses in contracts;
ensuring fairness and efficiency arising from technological innovations applied to arbitration;
legal framework applicable to online dispute resolution and blockchain-based arbitration, especially with regard to recognition and enforcement; and
access to justice in arbitrations involving sexual harassment.
The book concludes with three chapters on access to justice under the rules of arbitral institutions as revealed by studies of the World Intellectual Property Organisation, the Singapore International Arbitration Centre, and the International Centre for Settlement of Investment Disputes.
Arbitration provides a final binding decision that can be challenged on very limited grounds; thus, with arbitration settling disputes that were originally a prerogative of the judiciary, securing fairness in such procedures is paramount to the survival of arbitration. For this reason, arbitration practitioners, institutions, and academics will appreciate this deeply-informed analysis and commentary on a crucial aspect of a highly significant and rapidly evolving area of practice.Access to Justice in Arbitration = Access to Justice in Arbitration [texte imprimé] / Leonardo V.P. de OLIVEIRA, Auteur ; Sara HOURANI, Auteur . - KLUWER LAW INTERNATIONAL, 2020 . - 368 pages ; Relié.

Drawing upon diverse approaches, ADR experts from a variety of countries explore the situations to which ADR lends itself and the different permutations it offers to allow each dispute to be handled in the manner most fitting to the circumstances. The contributors also show how ADR serves such important considerations as the interests involved, the need to avoid a public display of differences, and the wish to anticipate problems.
By throwing new light on the achievements of ADR and the possibilities it offers, this book will help to situate ADR amongst the panoply of dispute resolution methods now available to the international business community.ADR in business : Alternative dispute resolution in business = Practice and Issues Across Countries and Cultures [texte imprimé] / Jean-Claude GOLDSMITH, Auteur . - KLUWER LAW INTERNATIONAL, 2006 . - 332 pages ; Relié.
