Self-Ownership, Property Rights, and the Human Body / Muireann QUIGLEY
Titre : Self-Ownership, Property Rights, and the Human Body Type de document : texte imprimé Auteurs : Muireann QUIGLEY, Auteur Editeur : Cambridge University Press Année de publication : 2020 ISBN/ISSN/EAN : 978-1-108-79774-0 Langues : Anglais (eng) Catégories : Droit de la santé, droit pharmaceutique, droit de la personne et du corps humain Mots-clés : propriété intellectuelle bioéthiques politique de la santé Index. décimale : 000 - pas d'indexation décimale connue Résumé : How ought the law to deal with novel challenges regarding the use and control of human biomaterials? As it stands the law is ill-equipped to deal with these. Quigley argues that advancing biotechnology means that the law must confront and move boundaries which it has constructed; in particular, those which delineate property from non-property in relation to biomaterials. Drawing together often disparate strands of property discourse, she offers a philosophical and legal re-analysis of the law in relation to property in the body and biomaterials. She advances a new defence, underpinned by self-ownership, of the position that persons ought to be seen as the prima facie holders of property rights in their separated biomaterials. This book will appeal to those interested in medical and property law, philosophy, bioethics, and health policy amongst others. Ethique des affairesMots-clés : compliance rules behavior corporate compliance ethics liability risk management supply chain deterrence incapacitation incentives evaluation Index. décimale : 346.065 : Droit des entreprises Résumé : Compliance has become key to our contemporary markets, societies, and modes of governance across a variety of public and private domains. While this has stimulated a rich body of empirical and practical expertise on compliance, thus far, there has been no comprehensive understanding of what compliance is or how it influences various fields and sectors. The academic knowledge of compliance has remained siloed along different disciplinary domains, regulatory and legal spheres, and mechanisms and interventions. This handbook bridges these divides to provide the first one-stop overview of what compliance is, how we can best study it, and the core mechanisms that shape it. Written by leading experts, chapters offer perspectives from across law, regulatory studies, management science, criminology, economics, sociology, and psychology. This volume is the definitive and comprehensive account of compliance. The Cambridge Handbook of Compliance [texte imprimé] / Benjamin von ROOIJ, Auteur ; D. United Nations agencies and other organizations are relying on PPPs to improve global health, facilitate access to scientific information, and encourage the diffusion of climate change technologies. For this reason, the 2030 Agenda for Sustainable Development highlights their centrality in the implementation of the Sustainable Development Goals (SDGs). At the same time, the intellectual property dimensions and implications of these efforts remain under-examined. Through selective case studies, this illuminating work contributes to a better understanding of the relationships between PPPs and intellectual property considered within a global knowledge governance framework, that includes innovation, capacity-building, technological learning, and diffusion. Linking global governance of knowledge via intellectual property to the SDGs, this is the first book to chart the activities of PPPs at this important nexus.
