Règlement des différendsMots-clés : droit des investissements droit de l'union européenne arbitrage d'investissement arbitrage international international arbitration investment arbitration Index. décimale : 000 - pas d'indexation décimale connue Résumé : This book is based on the Roundtable organized by the International Arbitration Institute (IAI) and the Max Planck Institute (MPI) Luxembourg for Procedural Law in April 2018. It was the first gathering of members of the European Court of Justice, judges of the International Court of Justice, EU Member State judges, distinguished arbitrators, representatives of arbitral institutions and academics convened at the aftermath of the recent Achmea ruling of the European Court of Justice. Part I focuses on the existence of systemic conflicts and incompatibilities between international investment law and EU law. After providing an overview of various investment agreements, the author examines a variety of issues that may arise from the overlap of EU law and international investment law and arbitration. Part II deals with the issue of recourse to international arbitration as a means of settlement of disputes to which EU law may be applicable, in particular, four key issues that characterize the relationship of EU law with international investment arbitration in light of the recent ECJ judgment in Achmea. Part III is a comparison of the substantive standards of investment protection under EU law and international investment law. The volume also includes the proceedings of the animated debates that followed each session of the Roundtable. It is essential reading for all those (judges, arbitrators, lawyers and academics) confronted with the issues arising from the relationship between EU law and international investment law and arbitration. -- EU Law and International Investment Arbitration [texte imprimé] / Emmanuel GAILLARD, Auteur ; Hélène RUIZ FABRI, Auteur . - JurisNet LLC, 2018 . - 717 pages ; Relié. - (IAI series on international arbitration; 11) .

Règlement des différends
Sources du droit et ouvrages généraux en droitMots-clés : arbitrage international jurisprudence droit français anglais cour de cassation Index. décimale : 000 - pas d'indexation décimale connue Résumé : The French law of international arbitration has a beginning (1963) and a culminating point (2007), but fortunately it does not have an ending. Indeed, it does not cease to evolve, to improve, to perfect itself. Thus it invites one to carefully observe it. But before undertaking this careful observation by annually identifying the most important decisions, as this collection has been doing since 2008, it is important to recall the origins of French law on international arbitration, how it was built, and in so doing, predict where it is heading. Looking into the past to anticipate the future, that is also the interest of a book like the present one.
This selection, necessarily subjective, is also shaped by the advantages that a retrospective look offers. The benefit of hindsight allows one to confidently distinguish between the decisions that deserve mention and those which did not make it into history. Only the former are printed in the following pages, but all of such decisions are included. Conversely, all decisions from 2008 onwards will be methodically published in the annual reports of this collection, of which two editions have already been released for the years 2008 and 2009.
Aimed for practitioners and academics alike, the knowledge of French case law is indispensable to understanding international arbitration and its important influence around the world.French International Arbitration Law Reports = 1963-2007 [texte imprimé] / Thomas CLAY, Auteur ; Philippe PINSOLLE, Auteur ; Thomas VOISIN, Auteur . - JurisNet LLC, 2014 . - 592 pages.

Règlement des différendsMots-clés : règles obligatoires arbitrage commercial arbitrage d'investissement arbitrage international arbitration Index. décimale : 000 - pas d'indexation décimale connue Résumé : The notion of mandatory rules of law has long been of interest in private international law. It is no wonder that the subject has also emerged as something of a preoccupation of those who are involved in the world of international commercial arbitration. As both legal academics and international arbitrators, the editors of this book took a keen interest in how mandatory rules might “fit” into the international arbitration picture. To better understand the phenomenon of mandatory rules (and to gauge whether its importance might possibly even be exaggerated in the international arbitral context), the editors convened at Columbia Law School at a workshop under the joint auspices of Columbia and the School of International Arbitration at Queen Mary University of London. The workshop gathered a small number of leading academics and practitioners to consider whether the notion of mandatory rules of law has a place in international arbitration and, if so, how it might best be accommodated Mandatory Rules in International Arbitration [texte imprimé] / George A BERMANN, Auteur ; Loukas A MISTELIS, Auteur . - JurisNet LLC, 2010 . - 339 pages ; Relié.

Règlement des différendsMots-clés : international arbitration arbitrage international soft law droit souple dispute différend commercial arbitration proceedings éthique disclosure of documents presentation of evidence preuves documents soft law guidance Index. décimale : 000 - pas d'indexation décimale connue Résumé : In recent years, a growing body of provisions called “protocols,” “guidelines,” “checklists” or even “rules” has emerged in international arbitration. Unlike national or international law, or institutional arbitral rules, these provisions are not “mandatory” for arbitration participants. They range from provisions that can be incorporated into the parties’ agreement to arbitrate to suggestions as to the best practices that arbitrators and other arbitration participants may choose to follow. These materials are often collectively referred to as “soft law.” Soft Law in International Arbitration provides a guide to what the editors consider to be the most useful of such materials. The book organizes these materials into five categories, each introduced with commentary by a prominent member of the international arbitration community. Thus, the eighteen documents contained in this book can be regarded as helping to fill in the spaces that substantive law and arbitration rules have intentionally left blank. Soft Law in International Arbitration is an indispensable commentary for practitioners and academics alike. Soft Law in International Arbitration [texte imprimé] / Lawrence W. Titre : The Law and Practice of United States Arbitration Type de document : texte imprimé Auteurs : Thomas E.CARBONNEAU, Auteur Editeur : JurisNet LLC Année de publication : 2020 Collection : Seventh Edition Importance : 604 pages ISBN/ISSN/EAN : 8032919996824 Langues : Anglais (eng) Catégories : Règlement des différends Mots-clés : law practice United States arbitration Index. décimale : 000 - pas d'indexation décimale connue Résumé : The Law and Practice of United States Arbitration is a comprehensive treatise about the development and practice of arbitration law in the United States. It addresses in detail the recourse to arbitration in domestic matters -- employment, labor, consumer transactions, and business -- and its use in the resolution of international commercial claims. It covers all of the major subject areas in the field and provides practical advice as well as an easy-to-read, clear discussion of the relevant case law. It represents a masterful synthesis of the entire body of arbitration law. It discusses basic concepts and doctrines, the FAA, freedom of contract in arbitration, arbitrability, the enforcement of awards, the use of arbitration in consumer and employment matters, institutional arbitration, and the drafting of arbitration agreements. It describes the federalization of the law and growing judicial objections to the use of adhesive arbitration agreements in the consumer context. A special edition of The Law and Practice of Arbitration was adapted and issued as Volume 31 of Moore's Federal Practice, one of the nation's leading treatises on federal courts and procedure. Moore's Federal Practice, published by LexisNexis, is one of the most cited texts in the legal world with over 50,000 citing opinions since it was first published in 1938.
The Seventh Edition of Law and Practice of United States Arbitration brings the existing material completely up-to-date and takes into account and provides thorough commentary on SCOTUS’ latest decisions. It provides a unique perspective into the value of arbitration for American society, the American legal system, and global commerce. Although the attachment to political convictions has mired arbitration into an unproductive debate in adhesive arbitration, that aspect of the use of arbitration has nothing to do with its larger mission. Arbitration is unique in the experience of American law because it actually works and achieves its aims. It is imbued in the Western democratic tradition and in that sense may be a difficult fit in other regions of the world. Finally, the support from national High Courts for arbitration is a vital part of the success of the process. Arbitration in the United States, England, and France would not have progressed and developed so well without the unqualified support of the judiciary. The Law and Practice of United States Arbitration [texte imprimé] / Thomas E.CARBONNEAU, Auteur . - JurisNet LLC, 2020 . - 604 pages. - (Seventh Edition) .
