Extraterritorial Use of Force against Non-State Actors / Dire TLADI
Titre : Extraterritorial Use of Force against Non-State Actors Type de document : texte imprimé Auteurs : Dire TLADI, Auteur Editeur : Brill Nijhoff Année de publication : 2022 Collection : The Pocket Books of The Hague Academy of International Law num. 50 Importance : 208 pages Format : Broché ISBN/ISSN/EAN : 978-90-04-52147-6 Langues : Anglais (eng) Catégories : Droit international public et organisations internationales Mots-clés : droit international public relations internationales guerre principe de non-intervention use of force ONU terrorisme lutte emploi de la force extraterritorialité paix légalité Résumé : This study assesses the rules of international law relevant to the use of force against non-State actors. The rules of international law on the use of force are the lynchpin of the project of international law for a more secure and peaceful world. Yet, as important as they are, the rules of international law on the use of force are also highly contentious. With the shift in the nature of conflicts from inter-State wars to conflicts involving non-State actors, and with the growth in the threat of global terrorism, the focus of the law on the use of force has shifted to the use of force against non-State actors. To assess the permissibility of the use of force against non-State actors, this study will focus on two grounds that have been advanced as bases for the extraterritorial use of force against non-State actors: the right of a State to act in self-defence and intervention by invitation. While there are other grounds that have been advanced for the extraterritorial use of force in international law, it is only in respect of these two grounds that the role of non-State actors has a significant influence on the legality or not of the use of force. This book explores the participation of this new category of actors in an international legal system that has historically been dominated by states. It explores the most important issues, actors and theoretical approaches with respect to these new participants in international law. It provides the reader with a comprehensive and state-of-the-art overview of the most important legal and political developments and perspectives. Relevant non-state actors discussed in this volume include, in particular, international governmental organisations, international non-governmental organisations, multinational companies, investors and armed opposition groups. Their legal position is considered in relation to specific issue-areas, such as humanitarian law, human rights, the use of force and international responsibility. The main legal theories on non-state actors' position in international law - neo-positivism, the policy-oriented approach and transnational law - are covered at the beginning of the book, and the essential political science perspectives - on non-state actors' role in international politics and globalisation, as well as their soft power - are presented at the end.
