Titre : The proliferation of privileged partnerships between the European Union and its neighbours Type de document : texte imprimé Auteurs : Sieglinde GSTÖHL, Auteur ; David PHINNEMORE, Auteur Editeur : Routledge Année de publication : 2019 Importance : 224 pages Format : Relié ISBN/ISSN/EAN : 978-1-138-35070-0 Langues : Anglais (eng) Catégories : Droit international public et organisations internationales Mots-clés : partenariat privilégié privileged partnership union européenne european union Index. décimale : 000 - pas d'indexation décimale connue Résumé :
This edited volume provides a timely analysis of the European Union's 'privileged' partnerships with neighbouring countries, identifying key points of comparison.
It analyses which policy areas are covered and why, the reasons why a specific institutional arrangement has been chosen, the major advantages and shortcomings for both sides and how effectively the privileged partnerships have worked in practice. Drawing on a number of case studies, the book highlights critical junctures and path dependence in the EU's external relations and examines what general lessons can be drawn regarding privileged partnerships, in particular with a view to the UK's post-Brexit relationship with the EU.
This book will be of key interest to scholars, students and practitioners in EU affairs, European politics, diplomacy studies, and more broadly to international relations and law.

Titre : The promotion of public health in EU external relations Type de document : texte imprimé Auteurs : Elisabet RUIZ CAIRO, Auteur Année de publication : 2021 ISBN/ISSN/EAN : 978-3-7255-8819-0 Langues : Anglais (eng) Catégories : Droit de la santé, droit pharmaceutique, droit de la personne et du corps humain Mots-clés : droit de la santé publique politiques externes Index. décimale : 000 - pas d'indexation décimale connue Résumé : This book examines how the European Union promotes public health in its external relations and evaluates the effectiveness of such action. The study aims at two sub-objectives: an examination of the constitutional framework governing EU public health, with a particular emphasis on its external dimension, and an assessment of the factors influencing the effectiveness of the promotion of EU public health at the global level. While the research undertakes a horizontal study of EU public health, it is illustrated by numerous case studies. These include the Union's external promotion of tobacco-control legislation, its role in the fight against cross-border health threats, the balance of trade interests and public health in bilateral trade and investment agreements, and the position of the Union towards intellectual property rights and public health at the WTO. Règlement des différendsMots-clés : exception d'ordre public arbitrage international convention de New York Index. décimale : 000 - pas d'indexation décimale connue Résumé : The Public Policy Exception under the New York Convention: History, Interpretation, and Application describes in detail the drafting history of the public policy exception of Art. V (2) (b) of the New York Convention in order to determine the purpose the signatory states wanted to achieve with this clause. The book also explains how this clause is applied by the courts in many economically relevant states, and especially in Brazil, Russia, India, and China.
In September 2012, the Indian Supreme Court, in a case entitled Bharat Aluminium Co. v. Kaiser Aluminium Technical Service, Inc., announced a long expected decision practically reversing the judgments of Bhatia International and Venture Global and holding that Indian Courts are not permitted to set aside foreign arbitral awards. In this Revised Edition, the author explains and explores the reasoning of the Indian Supreme Court in this landmark decision and discusses the practical implications and consequences.
Public Policy Exception under the New York Convention: History, Interpretation, and Application is of importance for all internationally active companies as well as for lawyers and courts. The book aids lawyers and companies in drafting arbitration clauses and in enforcing foreign arbitral awards. Often, judgments will not be enforced abroad; this is especially true with respect to an enforcement of foreign judgments in the BRIC countries. Therefore, internationally active companies and their advisors need guidance if and where foreign arbitral awards in their favor will be enforced abroad. The Public Policy Exception Under the New York Convention = History, Interpretation and Application [texte imprimé] / Anton G.
