Titre : The Development of Transnational Commercial Law Titre original : Policies and Problems Type de document : texte imprimé Auteurs : Roy GOODE, Auteur Editeur : Oxford University Press Année de publication : 2018 Importance : 423 pages Format : Relié ISBN/ISSN/EAN : 978-0-19-882581-4 Langues : Anglais (eng) Catégories : Droit du commerce, droit du commerce international Mots-clés : droit du commerce international relations privées et publiques harmonisation chambre du commerce international usages lex mercatoria résolution des différends arbitrage commercial international Index. décimale : 000 - pas d'indexation décimale connue Résumé : For over 40 years Professor Sir Roy Goode QC has been involved in the preparation of international instruments, working with the International Institute for the Unification of Private Law, the Hague Conference of Private International Law and the International Chamber of Commerce. The essays selected for this volume, written over the course of Sir Roy's career, offer a unique insight into the development of transnational commercial law, combining close theoretical study with an understanding of the practical relevance and application of the principles under discussion. Encompassing a range of topics, such as the processes and products of international harmonisation, comparative law and the conflict of laws, and placing a particular emphasis on the policies and problems of harmonisation, these essays were ground-breaking at the time of their publication and are still widely referenced to this day. Authorial commentary on the essays, provided through introductions to each section of the book, helps the reader to trace how the law has developed since, and often as a result of, the publication of each paper. Since then the subject has blossomed and is now taught at law schools around the world. Focused on the products and processes of the harmonization of law relating to international commercial transactions, the book is an invaluable resource for students in this field. In this new edition the work has been completely revised and updated, covering a number of new or substantially revised international instruments. In addition four new chapters have been added by specialist contributors dealing with regional harmonization, carriage of goods by sea, transactions in securities and the relationship between international conventions and national law. The authority of the text is enhanced by the fact that all the authors have played leading roles in the drafting and development of many of the instruments examined in the work.
